30 września 2015 r. Telco Holdings s.a.r.l, akcjonariusz P4, operatora sieci Play, powiadomił polski rząd o sporze dotyczącym inwestycji P4 na mocy Dwustronnej Umowy Inwestycyjnej zawartej pomiędzy Polską a Luksemburgiem.
Telco Holdings poinformował, iż zbliżająca się zmiana zasad trwającej aukcji LTE spowoduje nieodwracalne naruszenie interesów P4 oraz potencjalne materialne szkody w zakresie tej inwestycji przekraczające 500 mln euro. Rozumiejąc znaczenie aukcji LTE dla polskiego rynku telekomunikacyjnego oraz polskiej gospodarki, Telco Holdings jest zdecydowane dążyć do polubownego rozwiązania sporu z polskim rządem, który wspierać będzie szybki przydział częstotliwości bez naruszania praw uczestników będącej w toku aukcji.
Jeżeli polski rząd będzie nalegać na rozwiązania, które spotkały się z ostrą krytyką ze strony prawie całego polskiego sektora telekomunikacyjnego oraz jeżeli naruszy prawa uczestników aukcji, Telco Holdings będzie domagać się odszkodowania wszczynając postępowanie arbitrażowe przed właściwym międzynarodowym sądem arbitrażowym.

Telco Holdings s.a.r.l. , the Luxembourg based shareholder of the Polish mobile operator P4 Sp. z o.o., submitted on September 30th, 2015 to the Polish Government a notification of dispute under the Bilateral Investment Treaty between Poland and Luxembourg, regarding the P4 investment.
Telco Holdings notified that a upcoming change of the rules of the ongoing LTE auction will result in irreversible infringement of interests of P4 and potential tangible damages exceeding EUR 500 million to this investment. Understanding the importance of the LTE auction for the Polish telecom market and Polish economy, Telco Holdings is prepared to find urgently together with the Polish Government an amicable solutions, which would support quick spectrum allocation without violating the rights of the participants of the on-going auction.
Should the Polish government insist on solutions which met with strong criticism of almost entire Polish telecom industry and violate rights of auction participants, Telco Holdings shall seek a compensation by initiating an arbitration process in front of the relevant international arbitration court.
